Digital Millennium Copyright Act Notice & Takedown Policy
1. Respect for Intellectual Property
LFranca respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
2. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please notify our copyright agent. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including the URL or other specific location on our platform
- Your contact information, including your address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf

4. Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled, and the location where the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which LFranca may be found
- A statement that you will accept service of process from the person who provided the original notification or an agent of such person
If we receive a valid counter-notification, we may restore the removed material after 10-14 business days, unless the copyright owner files a court action against you.
5. Repeat Infringers
In accordance with the DMCA and other applicable law, LFranca has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Good Faith
Warning: The DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability. Please ensure that you are the copyright holder or authorized to act on their behalf before submitting a takedown notice.
7. Report Infringing Content
For faster processing of copyright complaints, you may also use our built-in reporting system. On any post or image, click the "Report" button and select "Copyright Infringement" as the reason.
